1. H-1B对申请人的工资有要求吗?

是的,H-1B除了对雇主有资质要求外,对申请人的工资也有一定的要求。一般来说,如果顺利在第一轮H1B抽签抽中,并且递交材料顺利,在当年10月1日H-1B正式生效之后,你的雇主要为你支付匹配现行工资标准的薪水,并且真实发放达到标准的工资。


2. 工资标准具体怎么分?

Level 1:

  • 一般只需要基础的理论知识、技能,知晓简单的操作等。因此,它是现行工资标准的最低水平。一般最低学历要求为本科学位,或1年以下的工作经验。

  • 刚毕业的New Grad应届生一般会选择申请这个级别。但川普执政期间,Level 1的申请经常会被RFE,之后为了提高H-1B的批准几率,即使是应届毕业生申请Level 2的情况也很常见。

Level 2:

  • 相比较于Level 1,需要更高级别的教育背景、相关经验以及专业知识。

  • 可以接受本科学位,但最好有2年以上的工作经验,硕士学历也可以申请这个级别,以弥补工作经验不足。

Level 3:

  • 这个级别是对应更有经验、承担更多职能的申请人准备的,中高层管理工作可以申请这一类别。

  • 一般来说,本科学历加3年以上工作经验可以尝试申请。

Level 4:

  • 适用于拥有更丰富的经验和专业知识,同时具备本科以上高等学历的申请人。

  • 一般来说,申请人需要在雇主公司担任高层管理职位。


3. “如何确认我的薪水符合H-1B的工资标准?”

1. 登录“Foreign Labor Certification Data Center/外籍劳工认证数据中心”网站,并选择FLC Wage Search Wizard开始查询。

2. 选择你的雇主公司所在州,比如California,然后选择继续。

3. 在选择【7/2022-6/2023 All Industries Database】后,选择你公司所在的具体county,比如谷歌的南湾office在Sunnyvale,那么可以选择Santa Clara County。
